Q:  Does the lender have to provide a disclosure when it requires the use of a particular provider to perform a settlement service?

A:  No.  Prior to January 1, 2010, a lender that required the use of a particular provider, such as an appraiser or credit bureau, was required to disclose the provider, the provider’s relationship to the lender, and certain other information, or indicate that the lender would pick from a list of at least 5 providers.  However, such disclosure was eliminated with the revisions to RESPA that went into effect on January 1, 2010.
