Int Q&A – Notice 4 – What will constitute appropriate form of notice to the servicer?

Q:  Notice 4 – What will constitute appropriate form of notice to the servicer?

A:   Delivery to the servicer of a copy of the notice given to the borrower is appropriate notice. The Regulation also provides that the notice can be made either electronically or by a written copy.

In the case of a servicer affiliated with the lender, the Act requires the lender to notify the servicer of special flood hazards and the Regulation reflects this requirement. Neither the Act nor the Regulation contains an exception for affiliates.
